1. Acceptance of Terms

By accessing or using the services provided by Braysons Host ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services

Braysons Host provides web hosting, domain registration, email hosting, VPS servers, dedicated servers, and related services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to customers.

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorised use of your account.
• Be responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree not to use our services to:

• Host, distribute, or transmit any illegal content.
• Send unsolicited bulk email (spam).
• Engage in phishing, fraud, or deceptive practices.
• Distribute malware, viruses, or harmful code.
• Infringe on intellectual property rights of others.
• Conduct activities that overload or disrupt our infrastructure.
• Violate any applicable Kenyan or international laws.

Violation of this policy may result in immediate account suspension or termination without refund.

5. Payment and Billing

All fees are payable in advance. We accept M-Pesa, bank transfer, and other payment methods as listed on our website. By providing payment information, you authorise us to charge the applicable fees.

• Services are billed on a monthly or annual basis as selected.
• Renewal invoices are sent before the due date.
• Failure to pay may result in service suspension after a grace period.
• All prices are in Kenyan Shillings (KES) unless otherwise stated.

6. Uptime and Service Level Agreement

We strive to maintain 99.9% uptime for all hosting services. Scheduled maintenance will be communicated in advance. Downtime caused by factors outside our control (force majeure, third-party outages, customer actions) is excluded from SLA calculations.

7. Data and Backups

While we perform daily backups as part of our service, you are solely responsible for maintaining your own backups of your data. We are not liable for data loss. We recommend keeping independent backups of all important data.

8. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Braysons Host and is protected by applicable intellectual property laws. You retain ownership of all content you upload to our servers.

9. Limitation of Liability

To the maximum extent permitted by law, Braysons Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services. Our total liability shall not exceed the amount paid by you for the service in the preceding three months.

10. Termination

Either party may terminate the service agreement with 30 days written notice. We reserve the right to terminate accounts immediately for violations of these terms. Upon termination, your data will be retained for 30 days before permanent deletion.

11. Governing Law

These Terms and Conditions are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.
